Formal application is hereby made by ___________________, a utility or city, to place a _____________________ across and/or beside the right-of-way of Cherokee County Road #________________ location of which is shown by a map and/or drawing, as well as being described as follows:
The attached drawing, or map, will show in detail a more exact spotting or location of the proposed installation. The installation will be placed a minimum of five (5) feet from the edge of the road surface, except where there is not sufficient right-of-way, and at a minimum depth of thirty six (36) inches. All paved or oiled road crossings will be bored and line buried at a minimum of thirty six (36) inches.
The Commissioner in whose precinct the installation will take place will have the authority to waive all or part of the above requirements. The Cherokee County Commissioner in whose precinct the construction is taking place shall have the power to stop the construction that does not conform to this notice. The matter shown on this notice shall then be reviewed at the next meeting of the Commissioners Court of Cherokee County for continued approval or denial.
Contractor, city or utility must notify the Commissioner when the project will begin. Upon completion of the project, the contractor, city or utility shall notify the Commissioner so that an inspection of the road may be conducted. The notification is required when a county Approval to Dig is issued.
Contractor, city and / or utility agrees to assume liability for any and all damages that may be caused by installation construction, including the roadway and the right-of-way involved. The owner-operator further agrees to comply with all state and federal rules and regulations concerning this project.
In the event of subsequent construction in connection with the repair and/or widening or improvement of the present roadway and/or right-of-way, the County may require the lowering, revamping, or relocating of the cable, line, pipe or whatever installation and the city / utility will bear all the expense of such lowering, revamping, or relocating the facility.
Attached hereto and incorporated herein for all purposes are maps, drawings, plots and other specifics of this project. If additional information is required, please notify authorizing agent.
